Buying Prozess
With us, the buying process is simple and hassle free…Once a price has been agreed with the vendor, both parties will be asked to sign a preliminary contract, a Contrato privado de compraventa and provide a 3000 euro reservation fee. In the contract will be a statement that the contract is not valid if a Nota Simple (copy of the deed registration), is not produced showing that the seller owns the property and that it is free of charges. (In Spain debts are charged to the property and any outstanding mortgage will be passed on to the buyer). This ensures that the property you are reserving to purchase, is in fact able to be purchased, free of debt and clear from impediments.
A non refundable deposit of 10% of the purchase price is requested to be payed at 30 days after the initial reservation of the property, which we will hold until completion of the Escritura.
The balance of the purchase price and all fees will be payable when the vendor & purchaser sign the Escritura de compraventa at the Notario, (Notary), the definitive contract equivalent to the Deeds of the property. If you are buying a new property you do not own the property until the work is completed and you are in receipt of the relevant certificates.
The Notario/Notary in Spain is a public official who will be required to witness the deed of sale.
You will also need an NIE number to purchase a property we will arrange the paperwork for you and will lead you through the process of applying for this essential documentation that enables you to purchase a home in Spain
